Patents are usually sought after by businesses to protect their ideas from others using or infringing on them. Many times consumers will think that when they see a product that says it has a patent that it will reflect on the quality they get. That just is not so usually. The patent office when it approves a patent application cannot build the product and test it; it is just not their job. Now certainly you may be able to feel out certain companies that seem to offer better quality products than others. But just because a patent was received on a product, does not mean that it is bullet proof.</p>
<p>So if you want protection in what you buy, you can start by making sure the warranty you receive on the product is solid and the terms are good. Beware of warranties that offer very little protection. You can then maybe head to the net and check out reviews written by consumers like yourself on products you’re considering buying. This can be a great way to see what others like you think.</p>

Imagine all of the large companies that have suits against them. Then imagine the suits that you never see make the news that go on all of the time as well.</p>
<p>But what is it with some organizations. They always seem to be in some sort of trouble. They have companies coming at them left and right making claims that they have stolen some sort of invention or idea that they have patented. Is it that these businesses are in trouble because they are always knowingly infringing on others ideas? Or maybe is it because they are large multi million dollar a year companies? Companies that make a ton can be a huge target for all sorts of lawsuits. They can also afford to have to pay out on a case that goes against them if they must. Look around the news and see which companies are out there that always seem to be in some sort of trouble. Chances are there will be several that are always making the news.</p>

			<content:encoded><![CDATA[<p>Well maybe it is not necessarily a fight, but it could end up being a huge legal matter if someone claims you have infringed on their patent, or the opposite someone has done the same to you. Just because you file a patent does not mean that everyone will respect it and not try and duplicate it. You have to realize that once you end up with a patent that you may deal with issues such as this. They certainly can be quite distressing and may end up being a huge issue when trying to deal with them. Should this stop you from ever getting a patent again? No, but it is something that you should keep in mind anytime you venture into any kind of business deal.</p>
<p>Ideas are tough to leave alone for the avid inventor. Unrealized ideas can be very frustrating so the would be inventor files for a patent and gets approved on their idea. Now what? Well just as we discuss before, you have to take into consideration that once you have obtained what so many want, you have entered an entirely new world of business. So take heed and remember to really think everything through before you rush into anything.</p>

Basically once a company or individual has an idea they can patent it as long as it falls into the regulatory guidelines set down by the government through the US Patent System. Once a patent has been applied for then received, then the company basically in different forms and fashion owns the rights to the idea and sometimes the parts and operation of it.</p>
<p>But is it really fair that once a patent is received that you cannot make that product? Well, whether you think it is or not, these are the rules set down by our government. And this country is not the only one that follows these same basic principles. Many countries have the same basic setup. Patent systems have also been in place nearly since the beginning of time. In one way or another, the country would try to protect the inventor from someone taking their idea for a certain period of time.  </p>
<p>So no matter what you think, the rules are there to protect everyone involved. If someone has a patent on something you want, then you will need to consider other options as to how you will make the same item.</p>

			<content:encoded><![CDATA[<p>The United States is by far not the only country to see a huge rise in the number of patents it sees almost annually. China announced just recently that their patents applications for the year of 2009 were through the roof, one of the highest percentages of increase they have even seen. They also recently implemented tons of new patent laws hoping to cut down on the high amounts of fraud cases they see as well as hoping it would streamline the entire process. The new laws just went into effect so it could be a year before critics are able to see just how the new processes are working.</p>
<p>In the US, our system is overloaded as well. The US is looking to make some much needed changes to its system soon; hoping to relieve their overworked employees as well as making the process easier. The patent system here has not seen any major changes since the 1970&#8217;s.</p>
<p>So no matter where you reside, first remember that there is more than likely a system to be followed when acquiring a patent. Also, make sure you are up to date annually with any changes that might affect whether or not you apply for a patent. These changes must be known or it could result in your getting a denial on your application.</p>

So how can obtaining more patents on ideas and inventions be a good thing? Some people get patents to protect inventions that they have to make sure that nobody else can take the brilliant idea that they have had. Many people obviously do it with the intention of making money. Certain ideas if they are good and big enough can really end up making money depending on of course how the entire situation is handled. Just because you end up with patent does not mean you just start making money. Usually it means you have to manufacture the goods then market them.</p>
<p>But when is enough, enough? That really all depends on each person. One factor may be that your patents just sit there once they are obtained. Remember for most the reason they want the patent is to eventually make money off their idea. It can also be daunting to end up with several patents, then having to market them all at the same time. This can really end up a high cost venture in the end. </p>

Well, this is something that many of them have trouble figuring out it seems. </p>
<p>Large corporations can open themselves up to huge settlements just by being in business. Patents are just one thing that companies like this must watch for as far as suits being filed against them. For the small time inventor, try and be careful when you decide to venture out on your own to sell a newly designed product. </p>
<p>There are ways that you can search for patents that may be similar to one you are going for. The more you search the better off you may end up being as far as making sure that you are completely legal going forward with your ideas. Nobody is perfect, and it can be a crazy world out there as far as business goes. So take care and have fun inventing.</p>

Many times people set these goals or resolutions never realizing their full potential to actually attempt to try any of them.</p>
<p>2010 can be different, if you want it to be. Inventors are everywhere, different ages, sex, race and IQ&#8217;s. With such diversity, this could prove to the “would be inventor” that they can do it, that they can invent something and get it to market. Sure, it will not be easy and may take some time to accomplish it. It also may not happen in a year. They key here would be that if you are going to start it, finish it. You never know if you may end up with a winner or not. Not doing anything though can sometimes be much tougher than failing or seeing that your idea just is not worth it. At least if you try you will know.</p>

It can really help you with figuring out how to do drawings and diagrams as well. Many people try filling out applications themselves due to the cost of patent attorneys. It is up to each person to determine if it is worth it for them to pay for help or not. The help can get quite costly depending on the size of your submission. So do your research and have fun.</p>

<p>If you first decide to hire someone else to push your product, you may end up forking over a lot of money. Usually marketing companies charge a large sum of money to do all of the work it takes to market your product. Sure they may have lots of contacts, but it can take time to hit up all of these contacts to try and get them to buy into what they are selling. This in turn can end up taking quite a few man hours.</p>
<p>The same can go for you. You will probably spend lots of times trying to sell your products. You will need to build your own contact lists and try and find your own contacts, but it can be done. Of course not all products end up huge, but yours could, you just never know. It will be likely that no matter who does the marketing, it will take time to see it through to the end though. So have fun, and you never know if your next idea may be the next big one on TV.</p>

<p>Well, you could go ahead and market your product under the label patent pending. The risk here would certainly be up to you as to how you would want to handle it. Sure if you get your patent then you will be OK, but if you do not you may be putting your product out there with not a lot of protection.</p>
<p>Different countries vary on how they handle patent pending type products. You should really consider reviewing all the laws regarding this in your area. It could be very important understanding everything before you make a decision as to how you will move forward. Also, if you plan on selling a product similar to a product that has a patent pending label, you may want to brush up on the laws as well.</p>

Whether you know them or not, the decision to tell others about your inventions should be something you would want to take very seriously. It will be important for you to weigh all of your options as to who you will want to let in on your invention prior to getting a patent. </p>
<p>According to many, your idea is technically not actually protected until you have that patent. Sure, you could prove that the idea was yours, but that could get really messy. You will want to make sure that you think this through, and you may need to realize that the idea may be worth more to protect than it is worth it to let others in on the deal.</p>
<p>Once you have your patent, you should then be good to go. But before that point you may want to be really careful. The idea behind the invention is to come up with something new. But if the idea gets into the wrong hands before you are done, who knows what could happen. So consider making a list of people you feel need to know and a list of those who you want to tell. Just be careful until you have your patent.</p>

			<content:encoded><![CDATA[<p>There are rumors that after over 30 years the patent system could see an overhaul. Certainly it seems this is not the fault of the person in charge of running it. It is really not up to him to institute major changes to the system. Changes to the system have to be approved by the governing body in place to really get any major changes through. One issue has been said to be that the employees that check these patents are heavily overworked. It takes almost 3 years to get a patent through, and if you do not make it through for approval on the first go, then it could take longer after you re-submit.</p>
<p>It seems that the system has just been overloaded with work. It has been really tough to keep the employees motivated with their day in and day out endless work of looking through patent after patent. They have tried to motivate them as best as possible with incentives and such for how much work they put out. </p>
<p>These changes could more than likely be a good thing for anyone involved. It could help smooth out the process for the patent seekers and the employees of the system.</p>

If you really want to try and invent something yet do not have any ideas yet, then there could be some places very close to you that you can start looking in. First look around your home maybe. There could be some great ideas just right around the corner from you. Consider some of the things you do daily and think if there are ways that you may be able to improve them. Or come up with some sort of thing that you think would make everyone&#8217;s life better at home. You could ask the family and see if they have some ideas floating around.</p>
<p>You also can just toy around with some things to see if they will fly or not. You never know what you may come up with. The point is you may want to try and have some fun with the project. Involve your family if you want. So start with yourself and work out from there, the possibilities are endless if you have an inventors mind!</p>

Some great inventions can be really small or huge. No matter what, if you think its great then many people may think so also and the impact that the invention has had on our world is probably huge.</p>
<p>Imagine where we would be without electricity. It plays a very important role in our society. Most of us cannot imagine going without it even for an hour or so.</p>
<p>Then there may be something as cheap and simple as hydrogen peroxide. Imagine the impact that this has had. You get a paper cut or a wound of some sort and just a little pour of this on it can be truly be life saving and keep you from getting a major infection. WOW.</p>
<p>Think of the impact that the internet has on your life and try to imagine not having it. It fuels our economy in a huge way and has become very important in most of our lives. Some of us out there even earn our living by using it. So the list of great inventions is obviously huge, what is on your list?</p>

Certainly that does not mean that every time a company receives a patent their stock will rise. It depends on what is being patented, the position it will provide to that company in the market they are in, and several other factors.</p>
<p>But for some businesses it can be vitally important to get a patent on key products. This will help them to ensure that their stock owners will have some faith that the company they invested in will have a product they believe in on the market that is like no other. Once these drugs undergo government approvals like the FDA, this can also tend sometimes to provide the stock with a value lift.</p>

Back then people were encouraged to come up with new ideas, new luxuries if you will for living. If they did come up with an idea they were given about 1 year to sell and market their goods without having to deal with competitors. At that point, after one year, the patent ran out and everyone was free to sell that person’s invention if they wanted to.</p>
<p>These ideas of the patent then have been used throughout time. Different countries of course have different systems. But overall the basic concepts of someone coming up with an idea and having the rights to it for a certain amount of time have been lingering on through history.</p>
<p>Now the patent system has surely grown. Patents can even take years to get and in lots of cases people are unable to even get one. Maybe their patent is too close to another or the idea did not fall under what is patentable. No matter what, the system has been used throughout time. As far back in history that has been recorded, people have used a very similar system.</p>

Patents can be a good way to protect an idea or invention you have though. It can be good to protect that idea from thieves, companies trying to duplicate what you want to do, or maybe you just want to protect the idea until you’re ready to market it, etc.</p>
<p>Have you ever just gone to Google and typed in the word patent to see what results come up? One of the first things that you may notice is there are lots of ads. These companies are more than likely paying a pretty good premium to have their pages come up number one in the Google search. Click on one of those sites and it just cost that business some money. But for them it seems it is worth it to have their ads out there. </p>
<p>The next thing you will more than likely see is Wikipedia. That site seems to come up quite often when you do a search for just about anything. There you can usually get some good information on the topic you choose. It can be a good place to start when researching something before moving on. </p>
<p>So try your own Google search to see what you find.</p>

Well from recent news articles circulating about, India and China want it that way for anything that falls into the category of clean technology. For one, they think it is up to the larger more industrialized countries to support the smaller less industrialized countries. The US and other countries feel that doing this could really stunt the growth of the industry.</p>
<p>Imagine a company coming up with an amazing way to patent wind powers, say it could revolutionize the industry, yet they cannot get patent on it. Many companies look to getting a patent on their ideas. This can be really important for business. For example, they might want to be the only one in an industry with a certain technology so it really sets them apart. </p>
<p>Sometimes businesses also invest quite a bit of money into the research of new technologies. If those technologies can be easily duplicated because they are not patent worthy, then their chances of getting their money back could become difficult.</p>
<p>So everyone wants to see a cleaner planet, but to say companies cannot patent their clean technological advances may be way off mark.</p>

Basically if someone has a way to do a shipping cart system for a website, they can technically patent the process if it gets approved because it involves tying it into a machine, which in this case is the PC. Normally under typical circumstances, the example they use was that Ford could not patent the assembly line and they did not. They are likening the software and PC argument to just that. </p>
<p>Most people have always thought it was a tough thing to deal with, giving patents out for methods used on an online businesses website for example. A ruling against the tech company could prove to be a huge issue for future companies when trying to file a patent for methodology style ideas.</p>
<p>What does all this mean? Depending on who you are, it can mean quite a bit. Imagine the drop in business for attorneys that deal specifically in web type patent infringement cases. Also web businesses may not be able to patent certain ways of doing business any longer.</p>
<p>So keep an eye out on this case, it really could change things.</p>

It sure seems so what with large companies coming up with new ways to do what it is they do. They usually seek for ways to do tasks cheaper, faster and sometimes with less manpower than before. These businesses can even have large facilities dedicated to inventing new technologies and products. </p>
<p>These businesses will also use test markets to study how a new product may work in a new area. They will get certain people groups together in a controlled environment and test products out on them before they release them for production or even further testing.</p>
<p>But to say there is nothing left in the world to invent is not so. Of course there may be some industries no longer really exist or perhaps they have very little to improve upon. But there are always new industries emerging, like solar power for example. Companies in this industry are racing to come up with better solar technologies. It is relatively a new industry and has much room for improvement. </p>
<p>As far as individuals go, there is still room for new ideas and improvements. There are tons of new products that hit the market annually. So if you have an inventor’s spirit, consider not giving up and getting your idea rolling.</p>

Tangible being something you can touch, put your finger on, etc. Here is an interesting <a href="http://www.prospect.org/csnc/blogs/tapped_archive?month=11&#038;year=2009&#038;base_name=supremes_question_the_wisdom_o">article</a> about the Supreme Court questioning the practice of being able to patent methods of doing business. Can you imagine that? If someone were to come up with a way, for example, to process a credit card in a unique way, they can apparently patent that. The deal seems to be that even though it is a method, which is usually not valid for a patent, once you transfer the idea into say some software on a PC, then it seems it can then become a patent.</p>
<p>Imagine that in the business world. It could really take the online/internet world by storm and apparently already has some. Facebook has already faced several law suits from companies claiming they have stolen methods of how they operate online. AMAZING.</p>
<p>So what do you think? Do you think that it&#8217;s OK to patent ways to do business or operate? It does seem that a rule like this can really cause a mess when it comes to patent infringement lawsuits. Certain types of business owners are probably thinking twice before they jump into certain markets due to this ruling.</p>

Well, for some people they will only find out once they actually try to produce what it is that has been swimming around in their heads or scratched down on multiple sheets of paper. Sometimes in our heads we tend to think we have brilliant ideas. At some point or another in most our lives we think we have a better way to make something or we may even think we have a great product to share with the world that nobody has ever seen before.</p>
<p>Well maybe that&#8217;s true. But very few people actually get up the nerve to take their ideas to the next level. That next level can be them trying to actually reproduce or transform that idea into actual reality.</p>
<p>Of course sometimes this can be difficult. At times you may have to bring in outside help to get the product off the ground. So if you have an idea swirling around inside of that head of yours, it is up to you and only you whether or not you can make it come to life.</p>

You may see a father in the garage late at night working on inventing some new tool to help around his workshop or a stay at home mom toying with the idea of something new to help her clean or cook. Imagine though if you got both their heads together. Or if in fact you got the kids and everyone together under the same roof and got them thinking on the project together. The results could be quite amazing. </p>
<p>The entire invention process could go much faster. Where there may be a problem, and when one person does not have the solution, another person could step in with a solution easily. </p>
<p>Whenever you solve a problem, some people always say that two heads are better than one. Well imagine four or five heads. Considering having the entire family in on one invention together could be a great idea for some families. Also imagine all of the quality time you could spend together. And you just never know what may come out of it. You never know when you could come up with that multi-million dollar idea. No matter what, just have some fun while you try and turn your ideas into real products.</p>

<p>So if you end up with a patent on a product, you just may never know what could end up happening. Patents can be a great way to protect an idea or invention. It’s not required for everyone out there to have one though. But if you do get one, you never know who might come along and ask for the rights to use it.</p>

No wonder tons of people tell others not to give up or if first you don&#8217;t succeed, try, try again. We have all heard these saying before. And for some of us maybe we should not give up. For others when an idea fails, maybe there are also good reasons to give up. It all depends.</p>
<p>Consider some of the huge products out on the market today. Post-it notes for example. They basically came up with the idea while trying to come up with another super style glue. From stories going around it seems that with sweet-n-low, parts of it were from some sort of pesticide. Also when Edison invented the light bulb, it took him failing lots of times before he got it just right. </p>
<p>So should you give up? You never know, what may seem wrong could end up turning into something right. Also, what you have may end up being something better than what you had originally anticipated. To give up or not, only you can decide.</p>

Some have seen their ideas come to life, not by their own hands, but by the hands of someone else that has the idea later on and pushed onward with it. Some people take their ideas, turn them into patents and try to get them to the market place. While others attempt to try to bring to life one of their ideas and fail, then give up.</p>
<p>Should you give up? We always hear never give up. Well, sometimes maybe it is OK to and sometimes maybe it&#8217;s not OK to. Really the choices are up to each individual. Maybe one person gives up because the idea is just too hard to bring to fruition. Maybe the next person gives up because they are tired of sinking money into it. Others may be trying to fulfill a lifelong dream and will stop at nothing to take their idea to the next level, and so on.</p>
<p>Whatever your idea is, maybe sitting down and planning out a course of action before you rush head long into it could work well to start. From there you can weigh all the options, costs, etc. and then make a decision how to proceed. </p>

One such way that people have found to try and make money is through turning their ideas into actual inventions. Some inventions can be as simple as a bread slicer and others a way to smash an atom. No matter how you slice it, people are trying to turn their latest ideas into viable products annually.</p>
<p>Depending on the idea and person, people will try and get a patent for their ideas. A patent can sometimes help to protect that idea. Just because a patent may be in the system, it does not necessarily mean that the patent actually was made into a viable product found on the market. It can vary but sometimes people file one to protect the idea and maybe their patented idea just never made it to market.</p>
<p>So are there too many inventions out there? Well in some ways maybe yes and in some ways no. </p>
<p>There are certainly lots of lawyers that deal with patents and inventions.  Do a Google search and you will see. You may want a lawyer that is specialized in that field. For example, you probably would not use a drunk driving lawyer or a probate lawyer to handle your invention ideas, normally most people head to patent attorneys if they use one at all.</p>

Meaning, how would this nation have grown without those people inventing new and better things all the time. As things were invented, they allowed for people to do their work better and smarter. It also provided those inventions to be exported and sold to other countries.</p>
<p>These inventions are truly a fuel for our economy. With the constancy of inventions, we can further progress the nation and keep up with other competing countries and businesses.</p>
<p>These inventions can bring us jobs. With the unemployment rates really jumping, the more items invented means the more items will need to be manufactured, which then ends up creating lots more jobs. Imagine how many people out there work for a company that deals with a patented product, working on a product line that someone invented.</p>
<p>So keep those inventions coming. It is amazing what we can do if we just put our minds to it. You invention could end up creating jobs and a living for someone out there needing work. You will never know unless you consider trying.</p>

Looking at the news on Google, this seems to happen a lot. What is going on? Well within certain industries there is tons of competition. You know how it is; for example a company comes out with a cell phone that takes pictures, soon after every other company has one. Companies on the top are always filing patents on their new technologies. Once the patents have been filed companies competing with them I guess should make sure that they are not violating the patent. </p>
<p>Well maybe they check closely, maybe they don&#8217;t, but once a product hits the market that appears to be like another company&#8217;s patent/product, then it makes sense that the company will go to work to get justice.</p>
<p>So what does this mean for the consumer? Well, I can say it does not lower prices on products. Think about it, if these companies are in court constantly suing each other, what do you think will happen?</p>
<p>But what can we do? Well nothing as far as I know. We want the new products, the companies have them, and so off we are to buy them. It would be nice though if they could all get along, it would surely save us money.</p>

<p>I went to Google, I typed in several keyword search combos of my idea to see if there were any similar ideas out there like it. I did find some gadgets that did what mine would do essentially, but theirs hade to be replaced every week or so. The point to mine is no replacing, only add a solution you can do from home and that is it. Plus I noticed some of these gadgets had no patent.</p>
<p>Last I went to the US Patent website, and then did my search which is free. I typed in the keywords that made sense and found a device that was no where near the same as mine.</p>
<p>So this search turned out well for me.</p>
<p>You may want to make sure you do a thorough search when looking for similar products already on the market that may match yours. No matter what, try and have fun&#8230;</p>

<p>First, you may want to do nothing at all. I did not. I have too much on my plate now as it is. Anything else would stress me out. If you do want to move forward though, a good start may be to search the internet or patent search system for possible matches. You never know, someone else may have had the idea already.</p>
<p>If you think the idea is fresh or new, then consider if you want to go to the expense of getting a patent, prototypes done, a proper design layout done, etc. There are so many aspects or details that you will get involved with in actually bringing a product to market. You will even have to consider if you want to pay to have the product manufactured yourself?</p>
<p>No matter what, do your research, think heavily on it and seek out advice if you feel you need it. Most importantly, if you can, try to have fun with it.</p>

A typical patent will last anywhere from 14 to 20 years from the filing date depending on the type of patent you filed. The time limit is good though, it helps keep the patent system open to new businesses looking to file or get patents on similar products and designs held by other companies.</p>
<p>The 14 to 20 years is a nice amount of time for a business to get the patent, and get the product to market. Once your product in on the market, you have plenty of time to brand your product and grab a major foothold in the market segment in which your product falls.</p>
<p>Once you lose protection though, you still may have the right to re-file, make modifications to the original, etc. Also depending on your product, there will more than likely be very few people looking to take your design and copy it. This is usually a much bigger problem that larger corporations have to deal with. Always check the US patent website for details.</p>

Perhaps you’re an expert in an area, let’s say in the lawn care business you know that cutting fuel and oil consumption would save you tons of money. The problem is that electrical powered equipment usually is not as strong or durable. What an opportunity to put your expertise to the test and help that industry move into a more eco friendly way of doing business.</p>
<p>Inventors do not have to be big business men or people with extremely high IQ&#8217;s. They can be and sometimes are the average worker or the much needed stay at home mom. The thing you have to ask your self is, do you have what it takes to take your idea to the next level. If you need help, go in with a family member or your spouse.</p>

<p>So where do you start? Well here are some suggestions, and these are just that, suggestions.</p>
<p>You will first want to start by writing down your idea on paper, getting as much detail down as possible. Then start some research. Search Google for products that may be like yours. Just type in the description of your product to see what&#8217;s out there. If you find nothing, then great, you can move on to the next step. That would be to do a patent search to make sure someone has not filed a patent on your idea. If you do not see anything like it, then that is great.</p>
<p>Next you will want to file your patent if you’re ready to move forward. Then you can go out and look for manufacturers to get a prototype. Now keep in mind, let&#8217;s say you will end up selling your item for $10, the prototype will cost lots more. Molds may have to be designed or tools made to make it. From there you possibly need help marketing your idea. And do not forget to get a website; it is a must for doing business today.</p>

<p>Basically, according to the president and members of his staff, they feel weakening the patent approval system could jeopardize the smaller business owners. Some of the largest companies today started as a tiny operation.</p>
<p>Sure, the patent system needs reform. Its nuts when you head to Google, in the news area type in patents, you can watch daily as the lawsuit articles pile up. Imagine there are tons more that do not even make the headlines.</p>
<p>The key is to keep everyone safe from patent issues caused by a reform, small and big businesses alike. The cost of products that we buy hinge on company costs. If companies are constantly in court and spending money defending themselves, then the cost of goods will certainly rise and share prices will be lower.</p>
<p>Yes, it&#8217;s time for reform, but be careful not to hurt the small investors in the process.</p>

<p>So what would happen if you did not get a patent? Well for one thing might be, once your idea hits the market, say you set up a website and sold your product there only. Someone could come along and try to take the idea. Not all ideas though are worthy of getting a patent, however. Let&#8217;s say you make handmade soaps. To you they are unique, but for the most part people out there everywhere make their own soaps and sell them to local shops or in small stores online. Your soap idea is more than likely not an idea worth getting a patent over, even if is more unique than the others.</p>
<p>When you do have an idea like no other on the market today though, then that is worth considering a patent for. This type of product then has the chance to become pretty big if it were to take off. At this point a patent would be a good idea. This will secure your invention for years to come.</p>
<p>Think through your idea, do some research and decide for yourself whether or not you want to get a patent for it.</p>
