Patent Reform Or Not

While battles rage onward legally by hundreds of companies over their patents being violated, the government is looking to overhaul the US patent system. The government has known since the 70′s that the changes made then would not last. Now the time has come to finally do something about the patent system, something that should have happened a long time ago.

Basically, according to the president and members of his staff, they feel weakening the patent approval system could jeopardize the smaller business owners. Some of the largest companies today started as a tiny operation.

Sure, the patent system needs reform. Its nuts when you head to Google, in the news area type in patents, you can watch daily as the lawsuit articles pile up. Imagine there are tons more that do not even make the headlines.

The key is to keep everyone safe from patent issues caused by a reform, small and big businesses alike. The cost of products that we buy hinge on company costs. If companies are constantly in court and spending money defending themselves, then the cost of goods will certainly rise and share prices will be lower.

Yes, it’s time for reform, but be careful not to hurt the small investors in the process.

Patents: Are They Worth It?

Once you have an idea or an invention in your head, you then have to decide how far you are willing to take it. Lots of people end up with patents and never end up even coming close to putting their item to market.

So what would happen if you did not get a patent? Well for one thing might be, once your idea hits the market, say you set up a website and sold your product there only. Someone could come along and try to take the idea. Not all ideas though are worthy of getting a patent, however. Let’s say you make handmade soaps. To you they are unique, but for the most part people out there everywhere make their own soaps and sell them to local shops or in small stores online. Your soap idea is more than likely not an idea worth getting a patent over, even if is more unique than the others.

When you do have an idea like no other on the market today though, then that is worth considering a patent for. This type of product then has the chance to become pretty big if it were to take off. At this point a patent would be a good idea. This will secure your invention for years to come.

Think through your idea, do some research and decide for yourself whether or not you want to get a patent for it.

Patents Can Be Fun

What in the world do I mean by this? Well, most of us arm chair inventors out there have felt at one time or another that we have come up with an amazing invention. -Yet never got up long enough from the recliner to do anything about it. That is me, that’s for sure.

But imagine this is a great time to bond with your kids or a loved one. Let’s say you already have an idea in your head. You think it’s brilliant of course, so now it is time to get a plan of action together and go for it. If you’re not going to need any outside help, feel free to skip the patent portion of the process first and go forward with the design and prototype stage.

Now that you have gotten your idea on paper, maybe some mock up drawings, it is time to build your first prototype. You need to decide, and it would probably be wise, to go ahead and file for the patent. You do not want anyone to steal your idea while you’re working on it or having various components out sourced.

This whole process can be a blast especially if you have a son or daughter that you would want to take part in it with you. So stop sitting around, turn off the TV and have fun trying to make you dream a reality.

Lawsuit Target: Facebook

Another day, another patent infringement lawsuit filed against Facebook. That’s right, these guys have been sued so many times that I’m sure by now they have lost count. Why in the world would people go after Facebook? And why is this happening to them? Here is a good article to start on their latest lawsuit.

For one, Facebook is a target because of their popularity. This company is raking in the dough, and that makes some people greedy or upset. Upset because to them they have stolen key elements of their technologies that they hold patents on. Imagine that, you start a web site, you have a great idea, but somewhere in the world an element of that web site was copied. How in the world can you not fall into such a situation? Did Facebook actually try and steal the elements in dispute? I do not know for sure, but in the past this has happened to other companies and it was ruled in their favor that they did not steal a single thing.

Patents can be great, but they do also limit us as to what we can do as far as what we can use when starting up a new business. Be careful!

Patents, Be Careful

Getting a patent can be a great thing. After working so long and hard to get that invention through the stage of having the patent on it can bring great joy. Remember with that patent will come great responsibilities though.

First you will need to protect it. Just because you have that patent does not mean that someone may not try and steal it. You will need to watch the market you’re in carefully. In the event that you do find someone violating the patent, you will more than likely need to hire a lawyer to handle the case for you. You will need to find just the right lawyer to handle this type of case. Just like if you get a drunk driving charge you would call an attorney, for a patent infringement case for example call a New York Patent infringement attorney.

Lastly you will want to see your patent through to the marketplace. A patent that never sees the day of light as a real product ends up a huge waste of money.

So remember, getting a patent on an idea or product sounds great to most people, but it does come at a cost and can be a huge liability.

A Patent Search

What is the best way to search for a patent? Well first you could start at the US Patent Website to use their search tool. But you won’t probably want to stop there. Getting a patent can be a very serious thing. It should not be taken lightly, no matter what your invention is. You need to really spend the time to understand what it is you’re doing.

You will want to next, after doing a basic patent search on the US Patent Website, head out to a search engine and begin searching. Let’s say that you have invented a new curling iron that is solar powered. In your search engine inquiry, type in the words ‘solar powered curling iron’ and see what comes up. The internet is full of information. There are tons of websites on the web that may end up having information regarding your invention. You never know what to you sounds like a great and new idea, may turn out to be someone else’s invention.

The key in your search is to spend quite a bit of time making sure your ideas are new. Check out businesses and websites that seem to have something close to what you have invented. Make sure your idea, well- is just that, your idea.

I Have My Patent, Now What?

WOW, you actually got your patent. After such a long wait and possibly thousands of dollars you got it! So what in the world do you do next? At this point most people think that they have gotten past the hardest part. -The hardest part being getting the patent and spending the money to do so. Of course trying to write the patent in a way to get it through was no small task either.

At this point I hope you may have your  a prototype or two of your product. Depending on the intensity of what you have, say a simple new style of pencil or a more extensive product like a car that runs on banana peels for fuel, you now need to source out your manufacturer. Keep in mind that setting up production for anything, whether it’s that new pencil or your car, takes a considerable amount of money depending on who you find to do it all.

At first you may try and find a lower cost local company to do this. Wait, I should say, if at all possible if you can make your product yourself than great! With the economy the way it is, businesses are more desperate for work. Hunt these people down; you could save tons of money!

So in summary, make sure you have a working prototype, CAD drawings if possible, and more than likely a deep pocketbook to handle the costs. Do your research…
